Court strikes out N30.4m fraud cases.

A Surulere Magistrates’ Court in Lagos on Wednesday struck out two fraud cases involving N30.4 million for want of diligent prosecution.
The Chief Magistrate, Abiola Soladoye said since the prosecution had failed to show readiness to prosecute the case, she had no option than to strike it out.
She also noted that the complainant had failed to show up since the accused was arraigned in 2010 in the second case.
The first case involved three persons-- two bankers and a woman.
The accused -- Monday Iliya,35; Monday Aigbobo,44; and Stella Osadebe, 41 -- were arraigned on Oct. 19, 2010 for allegedly defrauding Union Bank of N30 million.

He said Iliya and Aigbobo, who were employees of the bank, conspired with Osadebe, a customer, to defraud the bank of N30 million by transferring the money into Osadebe’s account.
Olaide said the offences contravened Sections 422 and 516 of the Criminal Code, Laws of Lagos State.
Also, the second case involving two persons, including a woman, was stuck out because the complainant, Mrs Abiola Abdulsalam, wanted an out-of-court settlement.
The accused Monsurat Ajibade, 28; and Toyosi Olabode, 39 -- were first arraigned on Nov. 11, 2010 for allegedly defrauding Abdulsalam of N435, 000 under the pretext of buying dollars for her.

Regularise your appeal process, Appeal Court tells Nollywood actress, Ibinabo Fiberesima.

The Court of Appeal in Lagos on Wednesday directed Nollywood actress, Ibinabo Fiberesima, to regularise all processes in her appeal papers filed before the court.
The actress, who is currently on bail, is seeking a stay of execution of the judgment of a Lagos High Court.
Justice Deborah Oluwayemi had on Feb. 20, 2009 found Ibinabo guilty of murder through reckless and dangerous driving resulting in the death of one Dr Suraj Giwa.
She sentenced her to five years imprisonment without an option of fine.
At the resumed hearing of the appeal, the appellate court queried the non-inclusion of all the exhibits tendered at the lower court as part of the record of appeal transmitted from the lower court.
The court observed that the record of appeal transmitted was not comprehensive enough.
The court also observed that some pages of the record of the appeal were not legible hence nothing could be done on the appeal until it was amended.
An Igbosere Magistrates’ Court had fined Fiberesima N100,000, but not satisfied with that judgment, the Lagos State Attorney-General and Commissioner for Justice, Supo Sasore (SAN), filed an appeal at the Lagos High Court.
In her judgment, Justice Oluwayemi held that the N100,000 fine imposed by the lower court on Fiberesima was tantamount to judicial recklessness.
She held that it was unreasonable for a magistrate to give an option of N100,000 fine to someone who had taken the life of another person through dangerous driving.
The judge added that Section 28 of the Road Traffic Law, Cap R10 Laws of Lagos State 2003, on which the convict was found guilty, did not give an option of fine.
Oluwayemi held that the magistrate misdirected himself and might have been confused by the plea for leniency by the lawyer to the convict that the ex-beauty queen was a working mother.
According to her, when the term of imprisonment is mandatory, the court cannot change it. ...................................................................................................
