Police Challenge N.5m Judgment In Favour Of Ex-Convict
The police in Lagos have challenged a N500,000 fundamental human rights infringement judgment delivered in favour of an ex-convict, Bishop Kayode William, by an Ikeja High Court Judge, Justice Adeniyi Onigbanjo.
Bishop Williams is the coordinator of Prison Rehabilitation Ministry International (premi) a non governmental organisation that provides positive societal integration for Ex-Prisoners.
He was awarded N500,000 by Justice Onigbanjo for wrongfully detention at the Lagos Police Force Headquarters in Ikeja for five days without trial.
The clergy was allegedly picked up and detained for five days by some police officers over his alleged involvement in a case of fictitious petitions against some officials of the National Industrial Court.
After his release, Bishop Williams filed a fundamental human rights suit against the police and claimed that he was wrongfully detained for a crime he knew nothing about·
The police did not challenge the suit till judgment was delivered and N500,000 damage awarded in favor of Bishop Williams.
In a twist to the matter, police authorities late last year filed an application asking the court to reverse it earlier decision as no hearing notices were served on them·
In a ten-paragraph affidavit in support of the application, counsel to the police, Abraham Fadipe contended that hearing notices regarding the matter was not served on the police to intimate them about the pendency of the matter in court.
Counsel to Bishop Williams, however, challenged the police argument, saying they were properly notified about the case before judgment was delivered.
After hearing argument from both parties, Justice Onigbanjo adjourned the matter till 13 February, 2012 for ruling on the application.
