Keyamo Loses Appeal Over Of Property
A Court of Appeal sitting in Lagos has overruled an appeal by Lagos Lawyer, Festus Keyamo over a Lagos High Court Judgment stripping him of ownership of a property located at the medium income housing estate located at Ijaiye, Ogba.
Before proceeding to the court of appeal, Keyamo had dragged the present occupant of the property, Peter Folurunso and his two children before a Lagos high court in 2001 asking the court to hold that he is the rightful owner of the disputed property consisting of two flats.
In his evidence Keyamo told the court that the property was offered to him for sale by a company Baden-Moyet Ltd sometime in 2000 through a sublease.
However, In his defence, Peter Folorunso told the court that the disputed property was given to him by the owners of the property, Baden-Moyet Ltd following his financial contribution to the company. He said a receipt was given to him to that effect by the company.
He noted that he was shocked when Keyamo brought some thugs to evict him from the property with an eviction order from a rent tribunal.
During cross-examination, the managing Director of the Company who had earlier given evidence in the matter confirmed to the court that the property was actually a gift to the defendant but that no deed of assignment was given him by her company to cover the gift.
Delivering judgment in the suit, Justice Olateru-Olagbegi held that from evidence before her, the property rightfully belonged to Peter Folorunso since he holds the license to the house and the license has not been revoked by Baden-Moyet Ltd that issued it to him.
The Judge also held that the evidence by the MD of the company showed that Peter Folorunso was not a trespasser on the property as it was a gift to him in the name of his children.
Dissatisfied with the judgment, Keyamo proceeded to the Court of Appeal seeking to upturn the decision of the lower court.
Part of his case at the appeal was that the trial court erred in granting a relief not sought by the defendant when it ordered Baden-Moyet Ltd to issue a Deed of Assignment to the present occupant of the disputed property.
The Appeal Court, after considering Keyamo’s case and that of the respondents upheld the earlier judgment of lower court.
