Judge strikes out Onyeabor's suit against senate
A Federal High Court in Lagos on Friday struck out a case filed by a Lagos socialite, Angela Onyeador and her Company, Enta Associates Ltd., against the Senate challenging the inclusion of her name in the list of debtors of failed banks.
Also joined in the suit is the Nigeria Deposit Insurance Corporation NDIC, the Senate President, Chairman of Senate Committee on Banking, Insurance and Other Financial Institution.
Others are chairman of Senate Committee on Drugs, Narcotics and Anti-corruption as well as the EFCC.
Onyeador had instituted a claim of N1.5 billion against the defendants as exemplary and aggravated damages, on the grounds that she had paid her debt and that the Senate made a serious blunder by including her name in the list.
The Senate had on July 7, 2009 adopted the report of its Committee on Banking, Insurance and Other Financial Institutions and proceeded to make public the names of some alleged debtors to the nation’s failed banks, including the plaintiffs.
She contended that before the CBN revoked the license of Assurance Bank for failing to meet the N25 billion minimum capital base for banks in the country, she had repaid the loan facility to the NDIC.
Onyeador noted that the title documents used as security for the facility were later released to her in June, 2008.
The plaintiffs, therefore, urged the court to hold that the inclusion of their names in the list of debtors, despite liquidating the debts, amounted to a grievous violation of their fundamental human rights as enshrined in Section 36 (1) of the Constitution.
However, the defendants urged the court to dismiss the case on the grounds that the court lacked jurisdiction to entertain it.
Delivering his ruling on Friday, Justice Mohammed Idris held that the Court could not continue with the case because the affidavit of fact which the plaintiffs relied on was not filed along with originating summons.
