Lagos High Court fixes Jan. 20 to hear application on Lagos-Lekki-Epe toll plaza.


A Lagos High Court on Tuesday fixed Jan. 20 for the hearing of the substantive application in the suit challenging the legality of the construction of a toll plaza on the Lagos-Lekki-Epe Expressway.


A Lagos lawyer, Ebun-Olu Adegboruwa, had on Sept. 28 filed a suit challenging the Lagos State Government for constructing toll gates on the road.


The state government had in 2009 concessioned the road to the Lekki Concession Company LCC.


At the resumed hearing of the case, Tunde Fagbounlu SAN, counsel to the LCC, told the court that the claimant participated in a protest over the toll plaza on Jan. 4, 2011 as reported in the Compass newspaper.


Adegboruwa in the interview granted to the press said that the collection of toll was nothing but political propaganda for the impending elections.


He urged the court to hear the substantive application because the issue of toll collection had been overtaken by the Lagos State Government’s directive postponing the collection till further notice.


Adegboruwa told the court that the LCC took laws into its hands when it announced that the toll collection would commence on Jan. 3 despite the pending motion for injunction.


Justice Bolaji Candide-Johnson reprimanded the parties for adopting self-help after the matter was in court and adjourned the case till Jan. 20 for further hearing.


Meanwhile, some residents of Lagos have called on the Federal Government to stop the Lagos State Government from collecting tolls on the expressway.


Samuel Araola, a civil servant in Ajah, told NAN that the collection of tolls on such a strategic highway was “illegal and politically motivated.


He said Lekki-Epe Expressway should be accorded similar status such as the Lagos-Badagry Expressway and Lagos-Ibadan Expressway.


Another resident, Wale Sanni, described the proposed N200 toll as “insensitive to the plight of the masses”.


Some residents of Epe, Lekki and Ajah held a peaceful protest on Jan. 3 calling for outright cancellation of the toll collection on the expressway.

Man, 20, gets N50, 000 bail over theft of N75, 000 generators.


An Apapa Magistrates Court on Tuesday in Lagos granted a N50, 000 bail to a man, who allegedly stole four generators valued N75, 000.


The accused, Osuji Chibuba, 20, is standing trial for a three-count charge of felony, stealing and unlawful entering of a house.


He has, however, pleaded not guilty to the charge.


But the Prosecutor, Sgt. Uche Kalu told the court that the accused and others still at large, conspired and stole the generators on Dec. 15, 2010 at House 28, 52 Road, FESTAC Town, Lagos.


Kalu said the offence contravened Sections 390 (9), 412 and 516 of Criminal Code, laws of Lagos State.


Senior Magistrate, A. K. Shonubi granted the accused bail in the sum of N50, 000 with two sureties in like sum and adjourned further hearing till Jan. 17.

Amputee drags man to court.


A man, who allegedly assaulted a victim with a broken bottle and which resulted in the amputation of the latter’s hand, was on Tuesday docked at an Ikeja Chief Magistrates Court, Lagos.


The accused, Mayowa Oladosun, 27, faces a two-count charge of conspiracy and assault before Chief Magistrate D.T. Olatokun.


According to the prosecutor, Insp. Barth Nwaokenye, the accused used a broken bottle to cause ``a permanent bodily harm’’ on Rasaq Yisa.


Nwaokenye told the court that Oladosun and others at large, who were co-tenants, were fighting with Yisa’s mother over some unsettled issues.


He said Yisa came in from an outing, met the dispute and tried to mediate but the accused grabbed a bottle, broke it and stabbed him severally on his shoulder.


He explained that the injury inflicted on Yisa led to the amputation of the affected hand.


He said the alleged offences were committed on Dec. 5 at No. 12, Saka str. Shogunle, Oshodi, Lagos.


The prosecutor said that the offence was punishable under Sections 516 and 335 of the Criminal Code Laws of Lagos State.


The accused, however, pleaded not guilty to the charges.


Olatokun granted the accused bail in the sum of N500,000 with two sureties in like sum.


She adjourned the case till Feb. 2 for further hearing.
