Court denies Akingbola’s application for variation of bail condition.


A Federal High Court in Lagos on Friday held that the bail conditions granted to the former Chief Executive Officer of Intercontinental Bank Plc, Erastus Akingbola, would not be varied.

In his ruling, Justice Charles Archibong held that the bail conditions granted by Justice Mohammed Idris on Aug. 30 subsisted and were to be complied with.

I will not vary or review the conditions on which the accused was granted bail on these present charges,’’ Archibong said.

Akingbola had on Nov. 24 through his counsel, Felix Fagbohungbe, sought to vary his bail conditions.

Akingbola had applied for the release of his passport deposited with the court registrar to enable him to travel abroad to defend a suit in the UK.

He had also urged the court to stop all security agencies and their agents from preventing or prohibiting him from travelling outside Nigeria.

Meanwhile, the court has ordered the release of Akingbola’s property located at No. 12, Ruxton Road, Ikoyi, Lagos.

Archibong, in his ruling on the application held that the property was not in the schedule attached by the order of Justice Tijani Abubakar on Dec. 31, 2009.

Akingbola had filed a suit against the Chairman of Economic and Financial Crimes Commission , Farida Waziri, over the attachment of his property located at 12, Ruxton Road, Ikoyi.

He alleged that the property was not in the schedule of property that were ordered to be impounded by Justice Abubakar in December, 2009.

Archibong adjourned the criminal case till Feb.18, 2011 for the hearing of the amended charges filed by the EFCC.
