An Apapa Chief Magistrate’s Court, Lagos has struck out a three-count charge of house breaking and theft of bags of kola nuts preferred against two suspects.
The prosecution had told the court that the accused Ibrahim Sani and Ismaila Idi conspired and stole the kola nuts worth two hundred and twenty-one thousand naira.
Sergent Benedict Unawunwa alleged that the men had on April five broke into five shops at Suru Alaba Market, Lagos, and carted away the kola nuts.
He urged the court to adjourn the case to enable him to assemble more evidence against the duo.
Counsel to the accused, Obadia Abiye, asked the court to strike out the case following the prosecutor’s inability to produce the complainants and witnesses.
The accused had earlier pleaded not guilty to the charge and were granted bail.
While discharging them, the Chief Magistrate, Oluyemisi Adelaja, said the prosecution had not demonstrated enough seriousness to produce the complainants and witnesses, as earlier promised.
She rejected the prosecutor’s application for another adjournment, saying it will amount to delaying justice.
