Court grants wife’s petition to dissolve marriage over interference by in-laws.


A Mushin Grade `A’ Customary Court in Lagos on Thursday granted the petition of a petty-trader, Fasilat Lawal and dissolved her eight-year-old marriage over undue interference by her in-laws.

The court president, Abayomi Ipaye said after efforts to reconcile the couple had failed, the court had no option than to grant the petition commenced on July 14.

Fasilat, 28, had earlier testified that her estranged husband’s family did not accept her as their daughter-in-law.

Falilat said that when she prodded her man to know how he contracted the HIV, ``he later confessed that his parents influenced him to tell me so.

She told the court that her husband had been taking good care of her and the three children of the marriage aged eight, five and three.

She pleaded with the court to grant her the custody of the last two children, saying that the first child was already living with her husband.

Her husband, Fatai Lawal, 35, who claimed to be presently unemployed, consented to the dissolution of the marriage.

According to him, all my efforts to reconcile with my wife have failed.

Fatai urged the court to grant his wife her prayer but should grant him the custody of all three children.

Ipaye referred the custody of the children to the family court for adjudication.

He ordered the respondent to pay his former wife N5, 000 monthly for the upkeep of the last two children.

Man arraigned for theft of Nokia phone, cash

The police on Thursday arraigned 31-year -old Emeka Irouka, accused of stealing cash and a Nokia cellphone with a total value of N34,500.

Irouka is standing trial before a Yaba Magistrates Court in Lagos on a two-count charge of conspiracy and stealing.

The police prosecutor ,Insp. Gbeminiyi Agoi, told the court that the accused with others at large committed the offence on Dec. 5 at No 1 Apollo St., Makoko, Yaba.

The accused and his gang did steal the sum of N27,000 and a Nokia phone valued at N7,500, the property of one Esther Mesagan

The prosecutor said that the offence contravened Sections 390 (9) and 516 of the Criminal Code Law of Lagos State.

The accused pleaded not guilty.

The Magistrate, O.S Aka-Bashorun, granted the accused bail in the sum of N20,000 with one responsible surety in like sum.

Aka-Bashorun adjourned the case till Jan. 13, 2011 for further hearing.

Fake policeman, others arraigned for robbery

The police on Thursday arraigned a fake policeman, Kingsley Ighodaro, and four accomplices for allegedly robbing their victim of a Toyota Rav 4 Jeep and a Blackberry cellphone.

The total value of the stolen items was put at N1.245 million.

Ighodaro, 28, along with his accomplices - Kehinde Adekunle, 36, Akeem Hassan, 38, Shola Dele, 28 and Kenneth Obotuke, 34, is standing trial before an Ebute Meta Magistrates Court in Lagos.

The Prosecutor, Insp. Samuel Omoyeni alleged that Ighodaro had presented himself as a serving policeman transferred to the Dopemu Police Station, Lagos, where he surreptitiously obtained a gun which he latter used to rob.

The accused are charged with conspiracy and armed robbery.

Omoyeni told the court that the accused committed the offence on Aug. 24 at Dopemu, Agege, Lagos.

He said that their victim, Mr Nasiru Adebayo, was robbed of his car with Lagos number AK-422-KJA valued N1.2 million, a Blackberry worth N45,000 and other valuables.

The prosecutor said the offence contravened Sections 516 of the Criminal Code and 1(2) (a) of the Robbery and Firearms Act, Laws of the Federation 2004.

Their pleas were, however, not taken.

Omoyeni requested the accused be remanded in the same prison for easy transportation rather than taking to different prisons.

The Magistrate, M.O. Olubi, ordered that the accused be remanded at the Ikoyi Prisons till Jan. 28, 2011, pending when the court would get an advice from the State Director of Public Prosecutions.
