Fashola probe: Court fixes judgment for November one.
A Lagos High Court in Ikeja on Tuesday fixed Nov. 1 for the judgment in a suit to restrain the Lagos State House of Assembly from probing Gov. Babatunde Fashola.
The suit was filed by Richard Akinola urging the court to stop the legislators from investigating allegations of alleged financial impropriety levelled against the governor.
Counsel to the claimant, Bamidele Aturu, had asked the court to restrain the legislators from carrying out any investigation pending the determination of a substantive suit before the Court of Appeal.
Aturu in a 22 paragraph affidavit to support the originating summons prayed the court to make a declaration that the action of the legislators was unlawful.
He said it is an affront on administration of justice and the rule of law for the defendant and any of its agents, officers, servants, committees, in particular the Ad Hoc Committee set up on April 15, to continue to investigate or act on the purported investigation of allegations of financial impropriety levelled against the executive arm of Lagos State Government by a group which calls itself the `True face of Lagos'.”
Aturu therefore, asked the court for an order of perpetual injunction restraining the legislators from investigating Fashola pending application for an injunction against the continuation of the investigation at the Appeal Court.
In his submission, the Defence Counsel, Shola Shodipo, said the legislators were only performing their constitutional duties and responsibilities to the people of Lagos State.
Shodipo argued that the claimant had made the same application at the Appeal Court and prayed the court to dismiss the suit as it was an abuse of the court process.
Justice H.A.O. Abiru of the High Court of Lagos State had in its judgment on March 16, held that the setting up of a committee by the legislators was illegal.
The court also had held that certain conditions precedent in the 1999 Constitution was not complied with.
It, however, refused to grant the prayer of the claimant to the effect that the defendant can only conduct investigation if the purpose is to make a law or correct a defect in an existing law.
The Judge, Justice Opeyemi Oke, after hearing their arguments fixed Nov.1 for judgment.

Soyinka, Bakare urge Jonathan to intervene in the Ogun House Crisis
Nobel Laureate Prof. Wole Soyinka and the convener of the Save Nigeria Group Pastor Tunde Bakare, on Wednesday called on President Goodluck Jonathan to intervene in the crisis in the Ogun House of Assembly.

The group of nine members also approved the controversial N100 billion bond for the state and passed the supplementary budget, among other resolutions.
Speaking at the briefing, Bakare observed that to allow legislative business to begin in the House would help preserve constitutional rule and ensure that the dangerous precedent did not stand.
The Speaker should be allowed to call a meeting of the whole House where all related issues can be resolved for a lasting peace in the House and the state at large, Bakare said.
He explained that the SNG’s intervention in the Ogun crisis was mainly on the side of the constitution and the rule of law.
He described the event culminating in the impeachment of the Speaker as a continuation of the lawlessness in the nation in the last 11 years.
Bakare said it was unfortunate that the National Assembly, which ought to intervene in the matter, has maintained an undignified silence on the Ogun House debacle.
Present at the briefing were the secretary of the United Niger Delta Energy Development Security Strategy, Tony Urantta; Lagos State governorship candidate of the DPA in 2007 elections, Jimi Agbaje; and President of the Campaign for Democracy, Dr Joe Odumakin.
Others were the spokesman of the Afenifere Renewal Group, Yinka Odumakin; Laide Bakare as well as other members of the SNG.
Addressing a news conference organised by the SNG in Lagos, Soyinka urged the President to restore the matter to the path of legality and Constitutionality.
Soyinka said the impeachment of the Speaker was one of the crudest assaults on the nation’s democracy and an act of treason against the people.
Anyone who keeps quiet at this point is equally guilty of treason against the people’’ he said.
The Nobel Laureate said the first task before the lawmakers was to make peace with the people they represent because "the people have been violated".

Doctors’ strike: Hospitals deserted.
As doctors in the employ of Lagos State continue with their strike, public hospitals have become a shadow of themselves.
The hospitals have been almost deserted.
The strike, which has been on since Aug. 9, is to press for the implementation of the Consolidated Medical Salary Scale.
The doctors also want the sacked former chairman of the Medical Guild, Ibrahim Olaifa, reinstated, and the resumption of deduction of members' union dues and a downward review of their Pay-as-you-Earn taxes.
Many patients on admission had been discharged.
The paediatric, out-patient, dental and eye departments were deserted, while only the emergency unit offered skeletal services.
But at the HIV department of the Lagos State University Hospital, officials of the Institute of Human Virology in Nigeria were seen attending to patients.
A pharmacist said on condition of anonymity that all the units had been affected by the strike except the pharmacy, medical records and administrative departments.
Siji Bolodeoku , the Public Relations Officer, LASUTH, said the strike was not an issue that the management of the hospital could resolve with the doctors.
The Medical Guild and Association of Resident Doctors, Lagos Chapter, on Sept. 20, defied the state government’s directive to resume work or face sanctions.

NCC requests security for personnel to combat piracy.
The Nigeria Copyright Commission says the presence of Mobile policemen to give security cover to its operatives during raids on establishments engaged in piracy will further enhance its effectiveness.
Its Technical Adviser, Enforcement, Akeem Aponmade said in Lagos that its enforcement of the copyright laws was ineffective because its personnel do not carry arms.
Aponmade said such a squad was necessary because those engaged in piracy of intellectual property were economic saboteurs, who would do anything to protect their interest.
He explained that on a few occasion just before going on operation, the policemen deployed to work with the commission were withdrawn.
The adviser said just like the EFCC, the NCC should also be strengthened in order to effectively perform its duty.
Aponmade, who spoke on the sidelines of one-day seminar for journalists on Copyright Administration in Nigeria, organised by the commission, said that the country lost enormous revenue because of the activities of pirates.
He said the media also had a role to play in combating piracy by educating the public on the need to buy genuine works rather than the pirated copies.
Mr John Asein, Deputy Director of NCC, who delivered a lecture on "Copyright for Media Practitioners" said that the programme was to enlighten and educate the public on copyright.

Absence of examination bay hinders revenue generation.
The Nigeria Customs Service says absence of an examination bay and the global economic recession have affected the Seme Border Command in meeting its monthly revenue target.
Area Comptroller Seme Border, Maitama Kura said the two factors had hindered the command’s effective performance in spite its efforts.
The monthly revenue target set for the command is N500 million, but we were unable to make it because of the economic meltdown and lack of an examination bay at the border, he said.
Seme Command of Custom had declared a revenue of N443.02 million in August with about N6.6 million realised from the ECOWAS Trade Liberalisation Scheme goods.
Kura called on the contractors handling the examination bay project to speed up work to prevent carrying out the examination of goods on the roads.
According to him, his men would continue to wage war against smuggling, promising that he would continue to work to meet the revenue target.
He said the command was able to facilitate the ECOWAS Trade Liberalisation Scheme by allowing the free flow of trade with the sub-region.

He said the move was not only to fast track the dispensation of justice but also to clear both the accumulated cases and the new ones.

FRSC RECORDS HIGH ACCIDENTS WITHIN JANUARY AND AUGUST THIS YEAR.
The Federal Road Safety Corps on Tuesday said 3,389 road crashes were recorded nationwide from January to August this year as against 6,353 recorded within the same period in 2009.
Public Education Officer, Samuel Obayemi, said this in Lagos at the 3rd edition of the Don’t Drink and Drive Campaign organised by the Nigerian Breweries Plc in collaboration with the Commission.
Obayemi noted that the 2010 figure showed a 43.81 per cent decrease in road accidents.
The number of persons killed in 2010 within this period is 2,441 as against 4,142 recorded in 2009 41.07 per cent decrease, there is also a sharp decline in the number injured which is 11,256 as against 17,224 recorded in 2009 35.6 per cent decrease, he said.
He said the number of arrests made by the corps increased from 290,725 in 2009 to 383, 540 in 2010.
This is traceable to the fact that we have more commands and more patrol vehicles, thereby covering more kilometers.
We hope that before long, as we unrelentingly pursue the various programmes aimed at actualising safe use, even the arrests will become minimal,Obayemi said.
He said the sustenance of the Don’t Drink and Drive Campaign had become a necessary strategy to entrench sanity on the roads.
Plans are underway to work out modalities for the purchase of breathalysers which the corps is already discussing about with the Nigerian Breweries, he added.
According to the officer, the breathalysers will aid the corps in effectively determining the level of alcohol intake of motorists while driving.
Obayemi said road safety remained a collective responsibility, and urged that other corporate organisations should contribute their quota toward it.
The Nigerian Breweries Public Affairs Manager West, Vivien Ikem, said the company was partnering with Commission in organising the campaign to discourage drink-driving and reduce road accidents.
Ikem, who was represented by the company’s Corporate Affairs Adviser, Yusuf Ayeni, hoped that the campaign would continue to create public awareness on road safety especially by commercial motorcyclists.
The Don’t Drink and Drive Campaign is designed to promote responsible drinking among drivers and other road users, create awareness about the dangers of drink- driving and reduce alcohol –induced road accidents.
He said the company had in 2009 donated 7,500 the Commission -certified crash helmets to commercial motorcyclists in five selected cities in the country in a bid to improve road safety.
This year, we sustained that support with the distribution of 6,000 helmets in another five selected cities, Ikem said.
He explained that the number of helmets distributed by the company decreased this year because many states were banning the use of commercial motorcyclists in cities.

Soldiers not affected by Lagos ban on motorcycles, says spokesman.
The Nigeria Army has said soldiers are not affected by the law banning motorcycles from operating on highways in the state.
Army Public Relations Officer, 81 Division, Lt-Col. Kayode Ogunsanya said soldiers in uniform, riding motorcycles, had been given a waiver.
Ogunsanya however, said soldiers riding motorcycles were not permitted under the law to carry more than one person or refuse to use the right crash helmet.
Lagos State Government had on Sept. 1 prohibited motorcycles okada from operating on expressways, Lagos Island, Victoria Island and Ikoyi.
They were also barred from plying Funso Williams Avenue-Eko bridge-Apongbon, Murtala Muhammed Way Fadeyi-Yaba-Oyingbo-Idumota, third Mainland Bridge and network of roads around the state secretariat, Alausa, Ikeja.
Ogunsanya said Any soldier in uniform with proof of ownership of the motorcycle has been given permission to move about without restriction in Lagos.
According to him, the soldiers are given loans to purchase motorcycles to ease their movement while performing their official duties.
Ogunsanya said the waiver was a national decision aimed at reducing the use of commercial buses by soldiers.
Soldiers are usually embarrassed by commercial bus drivers because of the silent law on non-payment of transport fares by officers in uniform.

Legal adviser defends sanction on tax defaulters in Lagos.
Assistant Legal Adviser, Lagos Internal Revenue Service, Afolashade Afolayan says the sanction imposed on tax defaulters in the state is in line with provisions of the law.
She cited the law as the Lagos Board of Internal Revenue Law Section 104 Cap 8 Laws of the Federation of Nigeria 2004.
Afolayan said the law empowers the revenue service to confiscate goods and chattels of any defaulting organisation and sell same to recoup the tax owed.
She said the entrenchment of a strong tax system in the state required that all stakeholders should live up to their responsibilities as required by the law.
Afolayan said there had been complaints that the agency did not give adequate notice before sealing off the premises of defaulting companies.
She said the allegation was not true, and that the agency went beyond serving all the required notices before imposing sanction on erring companies as prescribed by the law.
The assistant legal adviser urged corporate organisations that had issues to settle on their taxes not to wait till when all the required notices were exhausted before coming to resolve their matters.
She commended some companies that had been remitting their taxes as and when due, and advised those that had not been doing so not to relax, because the law will soon catch up with them.

Babangida's regime worst violator of human rights.
The Nigerian Bar Association says the administration of former military President, retired General Ibrahim Babangida, has the worst human rights records in the annals of the country.
Its President, Joseph Daudu, stated this on Monday in Lagos at the presentation of a book entitled Fundamental rights enforcement in Nigeria 2nd Edition, written by Lagos lawyer, Femi Falana.
Daudu noted that Babangida rode on the crest of human rights into office and yet his regime surpassed other regimes in human rights violation.
He also advised Ogbonnaya Onovo, the Inspector-General of Police, to submit himself to the law following a contempt of court charge slammed on him recently by a judge.
Osagie Obayuwana, Edo Attorney-General and Commissioner for Justice, expressed concern over what he called enforcement of civil rights in the country.
He said Corruption and enforcement of fundamental human rights are twin problems facing the country.
The book reviewer, Wahab Shittu, said the book was a true reflection of the current state of the law as heralded by the enactment of the new Fundamental Rights Enforcement Procedure Rules of 2009.
He said the 361-page book would teach Nigerians about their rights and what to do when the rights were violated.
The author, Falana, commended the late human rights activist, Chief Gani Fawehinmi for being the brain behind the passage of the rules.
He said with the removal of locus standi from the law books, public interest litigation had been institutionalised in the field of human rights in Nigeria.
