An Ikeja High Court on Wednesday ordered the prosecution and the defence to collaborate to produce one Mr Barry-White Sunday who has been in detention for four years at Ikoyi Prison for alleged murder.
Justice Lateefa Okunnu gave the order during Sunday's arraignment after both sides could not ascertain his whereabouts.
The prosecutor, I.O. Aderigbigbe, told the court that he had no idea where Sunday was, adding that efforts were being made to locate him.
However, counsel to the accused, Chief Gabriel Giwa-Amu, claimed that Sunday was being kept incommunicado by state authorities on a frivolous charge of murder.
No corpse was recovered; no corpse was seen by the police. He was only arraigned at Ebute Meta Magistrate's Court 14 and remanded in custody.
Giwa-Amu argued that it was the duty of the state to produce the accused in court because they are the ones making the allegations.
Okunnu ordered both counsel to go to Ikoyi Prison to look for Sunday before the next sitting and adjourned the case to Oct. 18.
